Incident Case UXR-2026-0818-0002. This case examines a reported Covered California support experience involving a potentially relevant Special Enrollment remedy.

The objective

The contributor wanted to determine whether a lawful midyear plan-change route might apply after repeated alleged failures of the existing health-plan arrangement to provide specialist access within California requirements and, if so, enter the process that actually determines eligibility.

What the contributor reports

The contributor reports contacting Covered California multiple times during 2025 and 2026 about whether changing health plans was possible. During 2026 specialist-access problems, the contributor says the problem was described in ordinary language: the current insurance arrangement was allegedly not producing specialist access within California requirements, and the contributor wanted to know whether changing plans was possible.

The contributor reports being directed several times to a qualifying-life-event webpage or list and told, in substance, to determine whether the circumstances appeared there. The contributor says the interaction made the route sound unlikely to apply and therefore did not pursue it. No case-by-case contract-violation Special Enrollment determination was initiated through the reported contacts.

The existing public pathway

Covered California's qualifying-life-event information includes a health-plan contract-violation circumstance. California regulation provides a case-by-case Special Enrollment triggering event when an enrollee adequately demonstrates that a qualified health plan substantially violated a material provision of its contract in relation to that enrollee.

That establishes a process that can potentially be invoked. It does not establish the result of this contributor's hypothetical determination.
